Terms of Service
Effective date: September 21, 2026
These Terms of Service (“Terms”) are an agreement between you and Code 3 Academy, LLC (“Code 3 Academy,” “we,” “us”). They cover your use of code3academy.org, the Apollo scenario training app at scenarios.code3academy.org, and related services (together, the “Services”). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. Who can use the Services
You must be at least 18 years old, or have the permission of a parent or legal guardian who agrees to these Terms on your behalf. If you use the Services on behalf of a school, agency, or other organization, you confirm that you are authorized to accept these Terms for it.
2. Your account
Keep your login details secure and your account information accurate. Accounts are for one person and may not be shared. You are responsible for activity under your account. Tell us promptly at support@code3academy.org if you think your account has been compromised.
3. Training use only — not medical advice
The Services are an educational training aid. Apollo uses artificial intelligence to generate patient scenarios, responses, scoring, coaching, and debriefs. AI-generated content can be incomplete, outdated, or wrong.
- Nothing in the Services is medical advice, medical direction, or a standard of care, and it must never be used to make decisions about a real patient.
- The Services do not replace your training program, instructors, textbooks, local protocols, scope of practice, or medical director. Where they differ from Apollo, follow them, not Apollo.
- Scores and feedback are practice feedback. We do not guarantee any result on a course, certification exam, or licensing process.
- Code 3 Academy is not affiliated with, sponsored by, or endorsed by the National Registry of Emergency Medical Technicians (NREMT), CoAEMSP, or any equipment manufacturer. Names of third-party organizations and products are used only to describe compatibility or alignment and belong to their owners.
4. Do not enter real patient information
Do not enter protected health information or any details that could identify a real patient, including from clinical rotations, field internships, or your job. The Services are not designed to store patient information. Text you type into a scenario is sent to third-party AI providers to generate responses.
5. Plans, billing, and cancellation
- Free and paid plans. Plan features and limits are described on our pricing page and may change over time.
- Automatic renewal. Paid plans are subscriptions billed in advance, monthly or annually. Your subscription renews automatically at the then-current price until you cancel.
- Cancelling. You can cancel at any time from your account. Cancellation stops future charges; you keep paid access through the end of the current billing period.
- Refunds. Payments are non-refundable, including for partial billing periods, except where the law requires otherwise. If you believe you were charged in error, contact us within 14 days and we will review it.
- Promo codes and free access. Promotional codes and complimentary access may be limited in time, may not be transferred or resold, and may be withdrawn if misused. When a promotional period ends, the plan renews at the regular price unless you cancel or no payment method is on file, in which case the account returns to the free plan.
- Price changes. We may change prices. We will give notice before a new price applies to your next renewal.
- Payments are processed by Stripe. We do not store your full card number.
6. Acceptable use
You agree not to:
- share, resell, or sublicense your account or the Services;
- copy, scrape, or bulk-export scenarios or other content, or use the Services to build a competing product or to train an AI model;
- attempt to bypass usage limits, security, or payment, or interfere with the Services;
- use the Services to produce unlawful, harassing, or harmful content; or
- misrepresent Apollo scores or reports as an official certification, credential, or accreditation record.
We may apply rate limits and may suspend accounts that violate these Terms.
7. Instructors and programs
If you use the Services with students, you are responsible for how you use them in your course, including any grading decisions. Apollo is designed for formative practice. You are responsible for obtaining any permissions your institution requires before directing students to the Services.
8. Your content and feedback
You keep ownership of what you type into the Services. You give us permission to store and process it to operate, secure, and improve the Services, including sending it to our service providers (such as AI, hosting, email, and payment providers) for those purposes. We may use de-identified and aggregated usage data to improve scenario quality and scoring. If you send us feedback or suggestions, we may use them without obligation to you.
9. Our content
The Services, including software, scenario frameworks, scoring methods, text, graphics, and branding, belong to Code 3 Academy, LLC or its licensors. We grant you a personal, non-exclusive, non-transferable license to use the Services for your own training, or your students’ training, while these Terms are in effect. Scenario exports available on your plan may be used for your own study or classroom instruction but may not be sold or published.
10. Suspension and termination
You may stop using the Services at any time. We may suspend or end your access if you violate these Terms, if required by law, or if we discontinue the Services. If we discontinue a paid Service, we will refund the unused portion of any prepaid period.
11. Disclaimers
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or clinically accurate.
12. Limitation of liability
To the fullest extent permitted by law, Code 3 Academy, LLC and its owners, employees, and contractors will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or opportunity, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
13. Indemnification
You agree to defend and hold harmless Code 3 Academy, LLC from claims, losses, and costs (including reasonable attorneys’ fees) arising from your misuse of the Services, your violation of these Terms, or your use of Apollo content in patient care.
14. Governing law
These Terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in New Mexico, and you consent to their jurisdiction.
15. Changes to these Terms
We may update these Terms. If we make material changes, we will post the new Terms with a new effective date and, where appropriate, notify you by email or in the app. Continuing to use the Services after the effective date means you accept the updated Terms.
